General Terms of Service and Data Protection

2. Scope

These terms apply to the provision of data, research, analytical and development services, as well as the protection of client-related data.

3. Nature of Services

Services are provided based on individual agreement.
Outputs are illustrative, research-oriented or prototypical and not intended for decision-making without validation.
Prototypes may have limited scope and are not intended for public distribution.

4. Orders and Delivery

Cooperation is considered binding upon written confirmation (email or form).
Outputs are delivered electronically (e.g., PDF, interactive tools, visualizations).
The provider reserves the right to decline or terminate cooperation.

5. Pricing and Payments

Pricing is determined individually based on the scope of work.
Payments are made based on invoice with a due date of 14 days, unless otherwise agreed.
A deposit may be required for larger projects.

6. Copyright

Outputs remain the intellectual property of the provider.
The client receives a non-exclusive license for agreed usage.
Without written consent, outputs may not be distributed, modified, or sold.

7. Liability

The provider is not liable for decisions made based on analytical outputs without expert interpretation.
The accuracy of models depends on the quality of input data and selected methods.

8. Personal Data Processing (GDPR)

8.1 Data Controller

The data controller is the provider mentioned in section 1.

8.2 Purpose of Processing

Communication with clients
Issuing invoices and accounting
Protection of the provider's rights (e.g., in case of a dispute)

8.3 Types of Data

Name, email address, billing information
Content of communication regarding the assignment

8.4 Legal Basis

Contract performance (Art. 6(1)(b) GDPR)
Legal obligation (accounting)
Legitimate interest (protection against misuse of outputs)

8.5 Data Retention

Data is retained during the course of cooperation and thereafter according to legal requirements.

8.6 Data Subject Rights

Right to access, rectification, and erasure
Right to restriction of processing and data portability
Right to lodge a complaint with the Data Protection Authority of the Slovak Republic

8.7 Data Sharing

Data is not shared with third parties except in cases required by law (e.g., accounting, tax office).

8.8 Data Collection and Input Usage

In certain cases, users may provide personal inputs through interactive prototypes, tools, or forms (e.g., questionnaire responses, personality scores, self-assessments). These inputs may be temporarily stored or processed solely for the following purposes:

to improve tool functionality and model accuracy,
to test analytical models,
for internal research and development by the provider.

These inputs will not be used for marketing, shared with third parties, or linked to an identifiable person unless necessary for development. If the data is stored long-term or reused, the user will be informed in advance.
